Terms of Service

Effective date: March 1, 2026

These Terms of Service ("Terms") govern your access to and use of services provided by Aperio Scale ("we," "us," or "our"). By booking a call, enrolling in a program, or engaging with our services, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree with any part, you should not use our services.

1. Description of Services

Aperio Scale provides YouTube consulting and done-with-you channel growth services, including but not limited to:

  • YouTube channel strategy and positioning
  • Content calendar creation and video ideation
  • Thumbnail and title (packaging) consulting
  • Script writing and retention coaching
  • Production and on-camera presence guidance
  • Launch strategy and analytics-driven optimization
  • Weekly and bi-weekly 1:1 coaching calls

Services are delivered through a 12-week "Done-With-You YouTube Growth System" program. The specific scope and deliverables are outlined in your individual engagement agreement.

2. Eligibility

Our services are intended for adults (18 years or older) who operate or intend to operate a legitimate business. By using our services, you represent that:

  • You are at least 18 years of age
  • You have the legal authority to enter into this agreement
  • You will use our services only for lawful business purposes

3. Strategy Calls

Booking a free strategy call does not create any obligation on either party to enter into a paid engagement. Strategy calls are exploratory conversations to assess fit and discuss potential approaches. No advice given during a free strategy call constitutes professional advice or a guarantee of results.

4. Payment Terms

Pricing for our programs is discussed and agreed upon during the application and onboarding process. Unless otherwise specified in your individual agreement:

  • Payment is due prior to the start of the program or according to the payment schedule outlined in your agreement
  • All payments are in US Dollars (USD)
  • Invoices not paid within 7 days of the due date may result in a pause or suspension of services

5. Results Guarantee and Refund Policy

We stand behind our system. Our standard guarantee is:

  • If you do not achieve 20-30 qualified strategy calls per month within 90 days of completing all program requirements, you are entitled to a full refund of program fees paid.

To qualify for the refund guarantee, you must:

  • Complete all 12 weeks of the program and attend all scheduled calls
  • Publish videos at the frequency agreed upon in your content plan (minimum 2 videos per month)
  • Implement the CTA and call-booking system as directed
  • Submit a written refund request within 30 days of the program end date

Refunds are not available for partial program completion, failure to follow the program methodology, or circumstances beyond our reasonable control. Refund requests are reviewed on a case-by-case basis and processed within 14 business days of approval.

We do not guarantee specific revenue amounts, close rates, or number of paying clients. Our guarantee applies to the volume of qualified strategy calls only.

6. Intellectual Property

Your content: You retain full ownership of your YouTube channel, all videos you produce, and any content created as part of the program. We make no claim to ownership of your channel or its content.

Our materials: All frameworks, templates, scripts, training materials, and methodologies provided by Aperio Scale remain our proprietary intellectual property. You are granted a personal, non-transferable license to use these materials for your own business. You may not resell, sublicense, or distribute our materials to third parties.

7. Confidentiality

Both parties agree to keep confidential any non-public information shared during the engagement. You agree not to share our proprietary frameworks or methodologies with competitors or publish them publicly. We agree to keep your business information, strategy, and financials confidential.

8. Client Responsibilities

You are responsible for:

  • Actively participating in all scheduled calls and sessions
  • Providing timely feedback on deliverables and materials
  • Producing and publishing video content as agreed
  • Maintaining your YouTube channel and associated accounts in good standing
  • Complying with YouTube's Terms of Service and Community Guidelines
  • Ensuring any claims made in your YouTube content are truthful and compliant with applicable laws

9. Limitation of Liability

To the maximum extent permitted by applicable law, Aperio Scale's total liability to you for any claims arising from or related to these Terms or our services shall not exceed the total fees you have paid to us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of profits, loss of business opportunity, or loss of data, even if advised of the possibility of such damages.

10. Disclaimer of Warranties

Our services are provided "as is" and "as available." We make no warranties, express or implied, regarding the fitness of our services for a particular purpose or that our services will meet your specific expectations. Results vary based on individual effort, niche, market conditions, and adherence to the program.

11. Termination

Either party may terminate the engagement by providing written notice. If you terminate before completing the program without cause, refund eligibility is determined by the terms in Section 5. We reserve the right to terminate your access to services immediately and without refund if you violate these Terms, engage in fraudulent activity, or act in a manner harmful to Aperio Scale or other clients.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation between the parties. If unresolved, disputes shall be submitted to binding arbitration before a mutually agreed arbitrator.

13. Changes to These Terms

We may update these Terms from time to time. We will notify active clients of material changes via email. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
